These Terms of Service ("Terms") explain your rights and responsibilities when you use PhotoScanRestore. Please read them carefully.

1. Acceptance of Terms

By accessing or using PhotoScanRestore, you agree to these Terms and to our Privacy Policy.

"Services" means the website at https://photoscanrestore.com, any related subdomains, and any PhotoScanRestore mobile applications or features we may make available.

If you do not agree to these Terms, do not use the Services.

We may update these Terms from time to time. If we make changes, we will post the updated version on this page and update the "Last updated" date. Your continued use of the Services after the updated Terms are posted means you accept the updated Terms.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to enter into these Terms. If you are under 18, you may only use the Services with parental or guardian consent and supervision.

2. The Services

PhotoScanRestore helps you upload, restore, enhance, organize, and share old photos, slides, and negatives. Depending on your plan, the Services can include:

  • Photo upload from your device
  • Automatic restoration and enhancement
  • Color correction, scratch and damage cleanup, face sharpening, and colorization
  • Album organization and private sharing with family or invited contacts
  • Photo export and download

Some features are free (such as demo restoration). Full or higher-usage features require a paid plan.

To use certain features, you may need to create an account and provide personal information. You agree to provide accurate information and keep it up to date.

You are responsible for safeguarding your account credentials and for all activity under your account. If you suspect unauthorized access, contact us immediately at hello@photoscanrestore.com.

The Services are not directed to children under 13. We do not knowingly collect personal information from children under 13.

Some features use automated image processing technology to enhance, restore, colorize, and sharpen your photos. These processes may run on our servers or through third-party processing services. Results can vary, and we do not guarantee specific outcomes.

3. License and Limitations of Use

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, and revocable license to use the Services for personal, non-commercial use.

You must not:

  • Copy, modify, reverse engineer, decompile, or create derivative works of the Services
  • Use the Services for unlawful, abusive, harmful, fraudulent, or offensive purposes
  • Upload malware, viruses, or malicious code
  • Use bots, scraping tools, or automated means to extract data from the Services
  • Attempt to access, test, or interfere with other users' accounts, data, or systems
  • Resell, sublicense, lease, or commercially exploit access to the Services
  • Use outputs from the Services to train external AI or machine learning models

We may suspend or terminate your access if you violate these Terms.

4. Your Content

"Your Content" means photos, images, scans, metadata, captions, dates, audio, and any other materials you upload or submit through the Services.

You retain ownership of Your Content. We do not claim ownership of your photos or personal media.

By uploading Your Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and display Your Content only as needed to operate, secure, maintain, and improve the Services for you. This includes restoration processing, generating previews, backup storage, and sharing as you direct.

You represent and warrant that you have all rights and permissions needed to upload and use Your Content, and that Your Content does not infringe any third-party rights or violate any law.

If we introduce public or community-sharing features in the future, additional terms may apply to publicly shared content.

When you delete content or close your account, we may keep limited backups for a reasonable period for technical, legal, fraud-prevention, or disaster-recovery reasons.

You are solely responsible for Your Content and for any consequences of uploading or sharing it.

5. Intellectual Property

The Services, including software, code, design, user interface, branding, text, graphics, and all related technology, are owned by PhotoScanRestore or our licensors and are protected by intellectual property laws.

Except for the limited license granted in these Terms, no rights are transferred to you.

You may not copy, reproduce, distribute, publicly display, modify, or create derivative works from our intellectual property without prior written permission.

"PhotoScanRestore" and related marks, logos, and product names are our trademarks. You may not use them without our prior written consent.

6. Payments and Taxes

Some parts of the Services require payment. Current prices are shown at checkout at the time of purchase.

Payments are processed by Stripe. By making a payment, you also agree to Stripe's terms and privacy practices.

We may change pricing or plan features at any time. Any price change does not affect a purchase already completed under the previously displayed price.

Prices are shown in USD unless otherwise stated. You are responsible for any applicable taxes, duties, or government charges.

If we release paid features in a mobile app in the future, payment processing may also be subject to third-party app store billing terms.

7. Refund and Cancellation Policy

You may cancel your plan at any time through your account settings. Cancellation stops future billing, but cancellation alone does not automatically create a refund.

For web purchases, you may request a full refund within 7 days of your purchase date by contacting support@photoscanrestore.com. After 7 days, all sales are final.

Approved refunds are issued to your original payment method and typically appear within 5-10 business days, depending on your payment provider.

For one-time plans (including Project Pass), there is no recurring billing. Your access continues until the plan expiry date. After the 7-day refund window, no partial refunds are available.

If we introduce recurring subscriptions in the future, cancellation will stop renewal at the end of the current billing cycle, and access will continue until that cycle ends.

After cancellation or plan expiry, your photos and related data remain available for download for 30 days. After that 30-day period, data may be permanently deleted from active systems.

8. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that the Services will be uninterrupted, error-free, secure, or available at all times.

We do not guarantee that restoration or enhancement results will meet your expectations, be historically accurate, or be free from artifacts.

You are responsible for keeping your own backups of original photos and source files. We recommend retaining both your original physical copies and your own digital backups.

9. Limitation of Liability

To the maximum extent permitted by law, PhotoScanRestore will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or business opportunities.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Services is limited to the amount you paid to us in the 6 months before the event giving rise to the claim, or £1, whichever is less.

We are not liable for loss, corruption, alteration, or deletion of uploaded photos or data, including where caused by technical failure, third-party outages, or unauthorized access.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

10. Indemnification

You agree to indemnify, defend, and hold harmless PhotoScanRestore from and against any claims, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use or misuse of the Services
  • Your violation of these Terms
  • Your infringement of any third-party rights, including intellectual property or privacy rights
  • Your Content and how it is uploaded, shared, or used

11. Third-Party Services

The Services may contain integrations with or links to third-party services, such as Stripe for payments, Supabase for authentication and data services, Microsoft Azure for infrastructure hosting, and image or email providers such as Replicate and Resend.

Third-party services are governed by their own terms and policies. We are not responsible for third-party services, their availability, their content, or their privacy and security practices.

You should review third-party terms before using those services.

12. Termination

We may suspend or terminate your access to all or part of the Services at any time, with or without notice, if we reasonably believe you violated these Terms, created legal risk, or used the Services in a way that could harm users, us, or third parties.

You may stop using the Services at any time.

Upon termination, your license to use the Services ends immediately.

We may delete Your Content after termination, subject to applicable law and retention obligations described in our Privacy Policy.

Sections that by their nature should survive termination will survive, including sections on intellectual property, disclaimers, limitation of liability, indemnification, and general legal terms.

13. General Provisions

Governing law and jurisdiction. These Terms and any dispute or claim (including non-contractual disputes) are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, unless mandatory law in your country of residence requires otherwise.

Severability. If any part of these Terms is found unenforceable, the remaining provisions remain in full force.

Entire agreement. These Terms and our Privacy Policyconstitute the entire agreement between you and PhotoScanRestore regarding the Services.

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control, including outages, cyberattacks, labor disputes, natural disasters, acts of government, or telecom failures.

Time limit for claims. Any claim relating to the Services must be filed within one year from the date the cause of action arose, to the extent permitted by law.
